Does Severance Affect EI in Ontario?

The short answer: it depends how your severance is paid. Lump sum and salary continuance are treated completely differently by Service Canada.

The Short Answer

Employment Insurance treats severance as “earnings” that get allocated to the weeks after your job ends — which can delay when EI payments start. But the details matter enormously:

Lump-sum severance

The lump sum is allocated week by week at your normal weekly earnings rate. A $30,000 payout at $1,500/week pushes your EI start date out ~20 weeks. You still get EI — it just starts later.

Salary continuance

You’re technically still employed and on payroll, so you generally can’t collect EI during the continuance period at all. Benefits and pension accrual may continue — a real advantage worth weighing.

This is why how your severance is structured is a genuine negotiation point — the same dollars can mean very different EI outcomes.

Apply for EI Immediately — No Matter What

This is the single most important advice on this page: file your EI claim within days of your last day of work, even if you’re receiving severance. Service Canada handles the allocation; your job is to not miss the deadline. Waiting more than four weeks can cost you benefits entirely.

2026 Temporary EI Measures

In response to tariff-related economic disruption, the federal government introduced temporary EI measures in 2026 — including waiving the usual one-week waiting period and adjusting how severance interacts with benefits for affected workers. These measures are currently slated to run into 2027, but the details and eligibility change.
